Austrian court acquits ex-foreign ministry director Peterlik of disclosing Novichok formula to Russia-linked businessman

An Austrian court on Wednesday acquitted Johannes Peterlik, former secretary-general of the Austrian foreign ministry, of charges he disclosed the chemical formula of the Novichok nerve agent to a Russia-linked businessman, Euronews reported. Prosecutors alleged Peterlik in 2018 requested the classified report without official necessity and passed the formula, which the Soviet-era chemical weapons program developed and which was used in the 2018 Salisbury attack, to Jan Marsalek, an Austrian ex-Wirecard executive and fugitive since assessed to work with Russian intelligence services. The acquittal is a setback for the Austrian state security investigation into Marsalek-linked influence networks.

Analysis
Per single-outlet Euronews wire coverage, Peterlik's acquittal is likely to depress prosecutorial appetite for future cases against sub-ministerial officials with comparable Wirecard-era Russia exposure. The result compounds a structural credibility problem for DSN: classified material passed through official channels to a now-fugitive FSB asset, and a court still declined criminal culpability. The acquittal may reflect a narrow finding that Peterlik's official-need threshold was satisfied under Austrian law rather than exculpatory evidence, but that distinction does not reduce allied skepticism. European counterintelligence services are very likely to tighten information-sharing with DSN over the next 12 months, driving Austria further toward the margins of EU-INTCEN exchange already constrained by Vienna's diplomatic-hub tradition. Marsalek's in absentia prosecution is unlikely to produce convictions before year-end absent new cooperator testimony.
