Federal Court Hears New Legal Challenge to Trump Tariffs After Supreme Court IEEPA Ruling

A three-judge panel of the US Court of International Trade heard oral arguments Friday in a case seeking to overturn the temporary tariffs Trump imposed after the Supreme Court ruled 6-3 in February that IEEPA does not authorize tariffs. The remaining Section 122 tariffs, a 10 percent levy on nearly all imports covering an estimated $1.2 trillion of annual trade, are now the administration's preferred tool, with the overall effective tariff rate at 13.7 percent.

Analysis
If the Court of International Trade strikes down Section 122 tariffs, the administration has exhausted its statutory toolkit for broad-based tariffs. IEEPA was ruled out in February, and Section 301 investigations targeting specific countries won't produce results until mid-May at the earliest.
