German Government Proposes Unprecedented Expansion of BND and BfV Intelligence Powers While Weakening Oversight
BLUFBerlin's maximalist intelligence draft is unlikely to pass intact within 12 months, as constitutional constraints and coalition politics will probably force substantial concessions on oversight consolidation and the BSI vulnerability pipeline.
The German Interior Ministry, led by Alexander Dobrindt, published a 700-page draft law (Referentenentwurf) on July 5 to reform intelligence service law for the BND and BfV 123. The draft would let the BND conduct offensive cyber operations against foreign systems, exploit undisclosed zero-day vulnerabilities, and require the BSI to pass vulnerability findings to the BND before public disclosure 23. It would raise the cap on internet traffic the BND can divert for content analysis to 15 percent of total network capacity, permit facial recognition and real-time public tracking by both agencies, and grant the BfV new "protective measure" powers to intervene against threats without notifying affected individuals 12. The draft dissolves the G10 Commission and transfers its oversight functions, along with much of the Federal Data Protection Commissioner's current supervisory role over the services, to the Independent Oversight Council (UKRat), whose "administrative" review body would act only within periodic pre-approved audit programs 12. Projected costs run to roughly 40 million euros in one-time BND expenses and 269 million euros annually for BfV operations 23.
AnalysisPassage within the next 12 months is
unlikely, since dissolving the G10 Commission and stripping the Federal Data Protection Commissioner's oversight role invites the kind of Bundestag amendment and coalition negotiation that historically dilutes maximalist security drafts before a final vote. This judgment carries high confidence, given convergent independent domestic reporting drawing directly on the draft text rather than wire dependence, and no coalition partner has yet publicly committed to the oversight provisions as written. Committee review after the summer break, mandatory association comment, and a near-certain constitutional challenge on Article 10 grounds each offer a checkpoint where the BSI-to-BND vulnerability pipeline and UKRat consolidation could be narrowed. The 700-page scope may function as an opening negotiating position the ministry expects committee review to trim rather than a text it intends to pass unchanged. If enacted, the BND gains standing authority to withhold zero-days and expand bulk collection, forcing vendors and the BSI to plan around a weakened disclosure regime. If it stalls, current oversight norms hold through the next budget cycle.
