House Moves to Vote on FISA 702 Three-Year Extension Without Warrant Amendment Ahead of April 30 Sunset

Speaker Johnson unveiled a third FISA 702 reauthorization attempt on April 24 after two floor votes failed, with the authority set to lapse April 30. The new bill makes minimal changes from the failed prior version and does not include the warrant requirements that defeated earlier efforts. GOP hardliners including Rep. Scott Perry said they were not there yet. The House Rules Committee meets Monday to advance the bill.

Analysis
Whether Congress passes some form of 702 reauthorization within six months of the April lapse is uncertain. Congress has never permanently allowed 702 to lapse since 2008 and historically resolves reauthorization 3-6 months past deadline, but three consecutive floor-vote failures in 10 days, named GOP holdouts, and Jeffries conditioning Democratic votes on Patel removal differ structurally from prior fights. A clean short-term extension remains the most probable near-term vehicle and historically substitutes for the full package under deadline pressure, deferring the warrant-amendment debate to the fall session.
