Democrat Presses Commerce Department on Commercial Spyware Procurement

Rep. Summer Lee (D-PA), ranking Democrat on the House Federal Law Enforcement Subcommittee, sent Commerce Secretary Howard Lutnick a May 6 letter demanding a briefing by May 20 on NSO Group, Commerce-White House communications on commercial spyware, and any contacts with NSO executive chairman David Friedman, Trump's former ambassador to Israel. Lee cited Friedman's November public statement that the administration would be "receptive" to NSO technology and NSO's own court filings asserting that U.S. law enforcement or intelligence use of Pegasus is "reasonably foreseeable." The letter, first reported by CyberScoop, also cited DHS's April 2026 acknowledgment that ICE was using Paragon's Graphite spyware while declining to produce the legal analyses Lee's office had sought.

Commerce is unlikely to produce a substantive formal response within 90 days. DHS's April playbook of acknowledging deployment while refusing to surface legal analyses provides the template, and Friedman's November statement, made after he assumed the NSO chairmanship, forecloses the department's easiest distancing move without compelling disclosure.
