FBI Director Patel Ordered Criminal Investigation Into Agents Who Recalled Unverified Election Tip

BLUFCourtroom testimony exposed the political origins of the Floris-Benavides prosecution, but it is unlikely that Judge Faruqui dismisses or finds the evidence insufficient on any charge by November 20, given the low legal threshold at this stage.

FBI agent Bryan Witt testified at a two-day D.C. federal hearing that Director Kash Patel directed the Kansas City field office to open the investigation of former counterintelligence officials Nikki Floris and Bradley Benavides the day after President Trump's July speech on alleged intelligence suppression of Chinese 2020 election interference 12. Witt said he feared the probe would look "political" 23, and that Patel and the deputy director monitored progress and joined case-team video conferences 1. Emptywheel reported the trigger was Floris's role in recalling an FBI report, from an uncorroborated source, alleging China fabricated driver's licenses for Biden votes 4. The probe shifted to their 2023 House Judiciary testimony, and Witt conceded agents never interviewed Floris or congressional staff 12. Magistrate Judge Zia Faruqui struck an unsigned superseding complaint adding obstruction charges and plans a line-by-line probable cause review Thursday 12.

Analysis
Confidence is high because AP and CBS independently reported the same courtroom testimony, Reuters and the Maddow Blog track that record, and Emptywheel adds partisan analysis without new sourcing. The hearing still hurt the government: Witt conceded agents never interviewed Floris, the key congressional staffer did not attend the testimony, and the case began with Patel's order a day after Trump's speech. It is unlikely that Magistrate Judge Faruqui finds the evidence of a crime insufficient, or dismisses the complaint, as to at least one charge against Floris or Benavides by November 20. The evidentiary bar at this stage is low, and the judge's sharpest criticism targeted prosecutorial procedure rather than whether the alleged statements were false. The rebuke and the unsworn superseding complaint may instead signal skepticism of the merits, which could make rejecting the vague "Hunter Biden investigation" questions count by count more plausible than the low bar implies. If Faruqui rejects a count, DOJ leadership must rethink charging and Patel's exposure while the defense shifts to materiality motions. If the complaint survives, the case moves toward indictment and the defense turns to vindictive-prosecution discovery, where the origin testimony will matter most.
