International Court of Justice to Deliver Myanmar Genocide Judgment on November 19

BLUFIt is unlikely that the ICJ finds Myanmar committed genocide in its November 19 judgment, though even a narrower ruling on failure to prevent would create binding legal obligations and pressure for Security Council action.

The International Court of Justice announced on Tuesday that it will issue its judgment in The Gambia v. Myanmar, with 11 states intervening, on November 19 12. The ICJ press release gives the time as 10 a.m. in The Hague, while DVB, relaying Reuters, reported an 08:00 GMT start 13. Human Rights Watch said the judgment is final, cannot be appealed, and will end the proceedings 45. The Gambia, backed by the Organisation of Islamic Cooperation, filed the case in November 2019 over the 2017 campaign that drove more than 700,000 Rohingya into Bangladesh 35. Merits hearings ran in January 2026, and Myanmar maintains its operations were counterterrorism action against ARSA 35.

Analysis
The ICJ is unlikely to find on November 19 that Myanmar committed genocide in breach of Article II or III of the Genocide Convention. We have low confidence in this judgment because nothing signals the bench's reasoning; the record holds only the date, the time and the parties' pleadings. The decisive issue is dolus specialis, and the Court's 2015 Croatia v. Serbia test requires genocidal intent to be the sole reasonable inference from the conduct. Myanmar disputes the evidentiary weight of the UN Fact-Finding Mission reports that anchor Gambia's case. Sourcing is a single cluster, the ICJ and Human Rights Watch, relayed by DVB and Democrata, and DVB's 08:00 GMT start matches the ICJ's 10 a.m. Hague time only under daylight-saving assumptions. The Court could still find genocide, since the Mission documented mass killing, sexual violence and genocidal intent and the 11 intervening states favor a broad reading. A genocide finding would send Gambia, the OIC and the interveners to the Security Council and General Assembly and bolster South Africa v. Israel. A narrower failure-to-prevent finding would still bind Myanmar, open reparations and shift advocacy toward domestic prosecutions, though the Council has never acted on an ICJ judgment.
