North Korea Amends Constitution to Trigger Automatic Nuclear Strike if Government Decapitation Attempted

South Korea's National Intelligence Service disclosed on Thursday that North Korea amended Article 3 of its nuclear policy law at the first session of the 15th Supreme People's Assembly, with the change dated March 22. The revised article states: "If the command-and-control system over the state's nuclear forces is placed in danger by hostile forces' attacks, a nuclear strike shall be launched automatically and immediately." Bloomberg reported on May 7 that the same constitutional revision grants Kim Jong Un sole formal authority over nuclear weapons. South Korean intelligence characterized the amendment as codifying retaliatory-launch procedures for scenarios in which Kim is killed or incapacitated.

Embedding the launch trigger in the constitution rather than statute signals intent to bind Kim's successors to a retaliatory posture removing human discretion in command-disruption scenarios. The concurrent grant of sole nuclear authority to Kim creates a structural tension: automatic retaliation and centralized command are compatible only if Kim's incapacitation is unambiguously detectable before launch conditions are met, a technical threshold Pyongyang has not demonstrated. Per a single NIS disclosure with no independent text corroboration, explicit DPRK invocation of this provision during a crisis or exercise by end of 2026 is a roughly even chance. The amendment may instead be primarily a deterrence signal to US planners, formalizing a posture already implied by doctrine.
