FBI Considering Adding Economic Espionage Charge Against Saudi OpenAI Engineer
BLUFIt is unlikely that federal prosecutors add an economic espionage charge against Alfozan by mid-December, as the existing recording charge already secures detention while investigators await OpenAI's review of what the device captured.
The FBI is considering adding an economic espionage charge against Abdulrahman Alfozan, a Saudi national and former OpenAI engineer, a law-enforcement official told the Wall Street Journal, as relayed by Middle East Eye 1 and The Jerusalem Post 2. The official said investigators are examining whether he took OpenAI information to offer the Saudi government even without being recruited, and that the probe may produce no further charges 12. Alfozan, 35, currently faces a federal recording charge carrying up to five years for allegedly hiding a device behind a television in an executive conference room 1. Prosecutors cite frequent 2025-2026 WhatsApp contact with an unnamed Saudi royal family member and one-way Saudi-bound tickets, and he was denied bail on October 19 23. His lawyer, William Pernik, said he has received no notice of additional charges, and the next hearing is November 6 12.
AnalysisConfidence is low because every report traces to one anonymous law-enforcement account relayed through the Wall Street Journal, with no charging document or named official, and Middle East Eye's stronger reporting adds no independent sourcing. It is
unlikely that federal prosecutors file a new charge or
superseding indictment against Alfozan that includes economic espionage or another espionage-related offense between October 28 and December 15, 2026. The state-direction theory would require evidence that Alfozan passed information to Riyadh, which the filings do not show. The recording charge, royal-family WhatsApp contact and one-way tickets already justify detention, so prosecutors face little pressure to expand the case before the November 6 hearing. The leak may instead be meant to press Alfozan's defense and Riyadh toward a plea. Bail has resolved for the government, and the inquiry has widened from recording to possible trade-secret theft. OpenAI's review of what the device captured would move the charging decision. An espionage charge would push AI labs to treat insider access as a state threat and force US officials to decide how to respond to Saudi consular involvement.
