Trump Names Jay Clayton as DNI Nominee After Pulte Backlash
BLUFClayton's nomination likely resolves the confirmation standoff by mid-August, but Section 702 surveillance authorities will remain lapsed until at least June 23 with no legislative vehicle in place.
Trump announced on Thursday via Truth Social that Jay Clayton, U.S. attorney for the Southern District of New York and former SEC chairman, is his nominee to serve as director of national intelligence, replacing Tulsi Gabbard 12. The nomination followed two weeks of congressional opposition to Trump's plan to install federal housing chief Bill Pulte as acting DNI, with Democrats blocking FISA Section 702 reauthorization in protest of the Pulte pick 12. Trump said Thursday that Pulte will remain as acting DNI "for a little while" until Clayton is confirmed 1. Both chambers rejected short-term Section 702 extension votes before the House departed for recess until June 23, leaving surveillance authorities to lapse as of Friday 12.
AnalysisSection 702 surveillance authorities remain lapsed and no legislative vehicle exists to restore them before the House returns from recess on June 23. Clayton will
likely be confirmed by August 15, as endorsements across the Senate's partisan divide and his law enforcement and counterterrorism record reduce the risk of a protracted confirmation fight. We have high confidence in this judgment. Pulte's continuation as acting DNI in the interim preserves the institutional uncertainty that drove the original FISA standoff, and Senate Democrats have not committed to any 702 extension vehicle even after the Clayton announcement.
