Poland's Constitutional Crisis Deepens as Tusk Suspends Tribunal President

BLUFŚwięczkowski is very unlikely to be removed from the tribunal presidency by mid-November, leaving Tusk's government without a viable enforcement mechanism and raising coalition-fracture risk as Nawrocki courts junior partners.

Poland's Constitutional Tribunal website announced the suspension of its president, Bogdan Święczkowski, on Friday evening, and hundreds of protesters, including Law and Justice (PiS) leader Jarosław Kaczyński, rallied outside the court for a second night on Saturday 12. Police detained three protesters on Friday night after some threw objects at officers and tried to breach the security fence 2. Prime Minister Donald Tusk said Saturday his government would press ahead, and wrote on X that restoring the rule of law "requires decisive action" 13. President Karol Nawrocki turned back his Senegal-bound plane, said he helped Święczkowski enter the building, and met representatives of Poland 2050 (called Third Way in one AP report) and the Polish People's Party on Saturday; Tusk did not attend 24. Presidential aide Marcin Przydacz called the suspension an "illegal, forceful attempt to take over an important institution" 2.

Analysis
Moderate confidence rests on consistent reporting across outlets, but the outcome turns on court staff, police and coalition choices that open sources do not show, and because coverage traces to a single Associated Press line republished elsewhere, convergence is high while independence is low. Święczkowski is very unlikely to be physically removed from, or to stop exercising, the Constitutional Tribunal presidency by November 15, 2026. Nawrocki's personal escort of Święczkowski into the building and his veto record leave the government without an executive or legislative route to enforce a suspension announced only on the court's website. The presidential camp is betting the standoff will pull Poland 2050 and the Polish People's Party away from Tusk, so their attendance at Saturday's talks is the first indicator to watch. Street rallies a year before the election will harden PiS and government positions rather than force a settlement. The government may instead be running a legal test case, accepting practical failure while forcing the president and PiS to defend a tribunal the EU Court of Justice has called partial. If the suspension fails, EU institutions and coalition partners must plan for a prolonged dual-authority court and a strained coalition.
