Bipartisan Government Surveillance Reform Act Offers Alternative to Clean FISA 702 Extension; Warrant Requirement and Data Broker Ban Proposed

Sens. Wyden and Lee joined Reps. Davidson and Lofgren to introduce the Government Surveillance Reform Act, the only bipartisan bicameral FISA reform bill on offer. The legislation would require warrants for accessing Americans' data collected under Section 702, ban government purchases of data from commercial brokers, and prohibit reverse targeting of Americans. EPIC formally endorsed the bill. However, with Speaker Johnson committed to a clean extension and Jim Jordan reversing his long-held reform position to back the administration's preferred 18-month extension, the reform bill faces steep odds.

Analysis
The GSRA's bipartisan bicameral structure makes it the strongest reform vehicle tracked across prior briefs, but reform energy is now split three ways (SAFE, PLEWSA, GSRA) while the clean extension has unified leadership support. Jordan's reversal from long-held reform advocate to clean-extension backer removes a critical Congressional champion for warrant requirements.
