DOJ Reinstates Firing Squads and Electrocution as Federal Execution Methods

The Department of Justice on April 24 announced it will add firing squads, electrocution, and gas asphyxiation as methods for federal executions, according to a DOJ report fulfilling President Trump's commitment to resume capital punishment. Acting Attorney General Todd Blanche authorized seeking death sentences against nine individuals after Trump rescinded the prior moratorium on federal executions. The report also authorized the continued use of pentobarbital for lethal injections.

Analysis
The method expansion is declaratory for now: BOP lacks operational protocols, trained personnel, certified equipment, and configured facilities for any of the three new methods. State-level precedent shows multi-year gaps between statutory authorization and first use, making any of the three new methods very unlikely to be scheduled within the next six months. The nine authorized death-sentence targets face trial-and-sentencing timelines entirely separate from method availability. Pentobarbital lethal injection, the only method with existing BOP infrastructure, remains the sole realistic vector for any imminent scheduling.
