Warner Introduces Secure AI Development Act Requiring NSA Mandatory Pre-Deployment Testing of Frontier AI Models

BLUFWarner's mandatory NSA testing bill is unlikely to become law by end of 2026, but its NDAA-attachment pathway warrants monitoring as the likeliest vehicle for converting voluntary frontier-model benchmarking into a compulsory gate.

Sen. Mark Warner (D-VA), Senate Intelligence vice chairman, unveiled a six-bill "Framework for America's AI Future" on July 21, including the Secure AI Development Act, which would task the NSA with creating a mandatory pre-deployment testing process for frontier AI models to assess risk . The bill would also modernize CISA's vulnerability-disclosure processes, update NIST's National Vulnerability Database for AI-specific risks, create a voluntary AI safety incident reporting system modeled on aviation-industry reporting, and direct CISA, NSA, and NIST to develop AI supply chain protections against foreign adversaries . The package's other bills include the AI AGENT Act establishing an FTC registry for trusted consumer-facing AI agents, the SAFE AI Act targeting AI-generated child sexual abuse material, a data center disclosure and tax bill, and workforce measures . The NSA is already developing a frontier-model benchmarking process under President Trump's June 2 executive order, but participation in that program is voluntary .

Analysis
Congressional action does not itself constrain NSA's parallel voluntary benchmarking work, which continues under the June 2 executive order regardless of legislative outcome. Passage would convert that program from a voluntary participation model into a compulsory pre-deployment gate for frontier developers, forcing labs to submit models for government risk testing before release. The Secure AI Development Act is very unlikely to be enacted into law by year-end, given the absence of co-sponsors, committee referral, or markup since its July 21 unveiling. Moderate confidence rests on the consistent pattern of standalone member-introduced national-security tech bills failing without bipartisan support, though NDAA attachment via Warner's Armed Services and Intelligence committee positioning remains an unactivated pathway.
