German Data Protection Commissioner Warns BND Intelligence Reform Creates Serious Risks to Civil Liberties With Oversight Gap Until 2029
BLUFAbsent a coalition partner willing to reopen the bill, Germany's intelligence reform will likely pass within six months with expanded surveillance powers operating unchecked until early 2029.
Federal Data Protection Commissioner Louisa Specht-Riemenschneider told Süddeutsche Zeitung that Germany's intelligence reform imposes "unacceptable restrictions on fundamental rights" and predicted the Federal Constitutional Court would likely find the plans "go too far," warning services "should not act and intervene like police" 12. She said the draft would let the Office for the Protection of the Constitution and the BND access public and private video surveillance, including audio and real-time feeds, and use camera and drone footage obtained beyond legal limits, calling it state tolerance of law-breaking 13. She also called the BND's planned indefinite retention of personal data from open sources unconstitutional 13. The new oversight body, the Independent Control Council, is not due to start operating until early 2029, leaving citizens unable to file complaints for about two years once the law takes effect January 1, 2027, she said 123.
AnalysisThe reform will
likely advance toward Bundestag passage substantially in its current form within the next six months, leaving the oversight gap open until early 2029. That judgment reflects low confidence, since no coalition partner has yet signaled it will reopen the bill's text in response to the commissioner's objections. A single official's public warning does not compel legislative revision absent a coalition partner willing to condition support on amendments. Specht-Riemenschneider's own departure in September further narrows the window for her office to press changes before her oversight authority lapses. Any constitutional challenge would have to await passage and a party with standing, pushing exposure well past the six-month horizon.
